Terms of Service
Navigo product and related services are provided by Pixeta App Lab. These Terms of Service (“Terms”) govern your access to and use of Navigo mobile application and services (“Product”). Please read these Terms carefully. By accessing or using Navigo Products, you agree to be bound by these Terms, by our Acceptable Usage Policy and by our Privacy Policy.
By accessing, downloading, installing the Product, and using the Services, you represent to Navigo that you are competent to enter into a contract (i.e. you a major according to applicable law, of sound mind and not disqualified from entering into a contract under the applicable law) and you have read this Agreement, understand it and agree to be bound by its Terms.
Navigo Product
The Product allows users to track live location of their vehicles, having GPS devices gets fitted by Navigo, over the internet. These Terms of Service apply to all users of the Navigo Product. Vehicle location information is provided based on the latitude and longitude data received from GPS device fitted in your vehicle.
In order to access and use the features of the Product, you acknowledge and agree that you will have to provide Navigo with your mobile, the same that is supplied in the documents at time of GPS kit fitting in your vehicle. If you login on behalf of a company, organization, or other entity, then (a) “you” includes you and that entity, and (b) you represent and warrant that you are authorized to grant all permissions and licenses provided in these Terms and bind the entity to these Terms, and that you agree to these Terms on the entity’s behalf. We do not collect any other of your personal information. You must notify Navigo immediately of any breach of security or unauthorized use of your account. Although Navigo will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Navigo or others due to such unauthorized use.
Warranty Disclaimer
YOU AGREE THAT YOUR USE OF THE NAVIGO PRODUCT SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, NAVIGO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. NAVIGO MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS PRODUCT’S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR PRODUCT, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR PRODUCT THROUGH THE ACTIONS OF ANY THIRD PARTY.
Privacy Policy
Navigo (hereinafter “Navigo” / “We”) provides this Privacy Policy to help users of the Navigo mobile application and services (collectively Navigo Product) make an informed decision about whether to use or continue using the Navigo Product. If you do not agree to our practices, please do not use the Navigo Product.
The Product is intended for people who are competent to contract under applicable law. Individuals who are less than 18 years old are not permitted to use this Product unless the complete Agreement is seen and agreed by parents or their legal guardians under applicable law. You confirm that You are at least 18 year old or otherwise competent to contract including with consent of Your parent/legal guardian as may be required under applicable law.
Information Collection
Navigo Product may obtain the following types of Personally Identifying Information (information that can be used to identify you) from or concerning you or your mobile phone device as specified below:
You provide certain Personally Identifiable Information, such as Your mobile phone number and mobile device information to Navigo Product when choosing to participate in the use of the Navigo application, such as logging into the account.
Navigo Service may receive data whenever you connect service with an application. This may include date and time of connection, the web address, IP address information and your authentication tokens used. Your authentication tokens may be saved on the server for the sole purpose of seamless usage.
When you use the Navigo Product, our servers log certain general information that GPS device fitted in your vehicle sends whenever position of your device changes. The contents of vehicle position that have been submitted to Navigo Product will be stored in Navigo servers till the servers receive the next position data from same vehicle. In short, Navigo servers keep only latest position data of a particular vehicle. The purpose of this storage is to show last captured position of the vehicle to user when he/she starts tracking it.
Navigo may retain the information which Navigo is legally compelled to collect in accordance with retention policies applicable under Indian law.
Use of Information
We do not use your Personally Identifiable Information to send commercial or marketing messages without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out. We may, however, use your mobile number without further consent for non-marketing or administrative purposes (such as notifying you of Navigo Product changes or for customer service purposes).
We may use both your Personally Identifiable Information and certain non-personally-identifiable information (such as anonymous user usage data, IP addresses, etc.) to improve the quality and design of the Navigo Product and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends.
We may disclose the Personally Identifiable Information and available user contents as required pursuant to applicable laws, a directive or order of a government entity or statutory authority or any judicial or regulatory authority or to law enforcement agencies in any official investigation including but not limited to cyber incidents, prosecution and punishment of offenses. You agree that Navigo has the right to monitor the Product electronically from time to time and to disclose information as may be necessary to satisfy any law, regulation or other governmental request, to operate the Product properly for justified purposes that are relevant for the features and functionalities of the application and related services opted by you, or to protect itself or its subscribers. We will cooperate with the appropriate law enforcement authorities in investigating claims of illegal activity.
Data Security
We care about the security of our users. We cannot, however, ensure or warrant the security of any information transmitted to and from Navigo and you do so at your own risk. Using unsecured wifi or other unprotected networks is never recommended. Navigo makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If Navigo learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps.
In the event of Merger, Sale or Bankruptcy
In the event that Navigo is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.
Changes to this privacy policy
This Privacy Policy may be revised periodically and this will be reflected by the “effective date” below. Please revisit this page to stay aware of any changes. Your continued use of the Navigo Product constitutes your agreement to this Privacy Policy and any amendments.
